1. Introduction

DiMana Systems, LLC ("EMS1R," "we," "us," or "our") operates the EMS1R platform, a cloud-based Emergency Medical Services operations platform. This Privacy Policy describes how we collect, use, disclose, and safeguard your information when you visit ems1r.com or use our platform services. EMS1R is designed to comply with HIPAA, HITECH, and applicable state privacy laws including the CCPA/CPRA.

2. Information We Collect

• Information you provide: contact information, account credentials, billing information, support communications, form submissions and demo requests.
• Protected Health Information (PHI): EMS1R acts as a Business Associate under HIPAA and processes PHI only as directed by our customers (Covered Entities) pursuant to a Business Associate Agreement (BAA).
• Automatically collected: device information, IP address and approximate location, usage data, cookies.

3. How We Use Your Information

To provide and improve the platform; process dispatch, ePCR, fleet management, and scheduling operations; facilitate NEMSIS-compliant data submissions to state agencies; send operational alerts via email, SMS, and internal messaging; provide support; ensure platform security; comply with legal obligations; and generate de-identified, aggregated analytics.

4. HIPAA Compliance

EMS1R operates as a Business Associate under HIPAA with administrative, physical, and technical safeguards — AES-256 encryption at rest and in transit, role-based access controls, multi-factor authentication, complete audit trails, and Row-Level Security for agency-level data isolation. We execute BAAs with all customers who transmit PHI. PHI is never sold or shared for marketing. Breach notification follows the HIPAA Breach Notification Rule (no later than 60 days following discovery).

5. Data Security

SOC 2 aligned controls; AES-256 at rest and TLS 1.2+ in transit; biometric, RFID, and multi-factor authentication support; 24/7 monitoring with automated threat detection; automated failover (<30 seconds); regular penetration testing; complete audit trails.

6. Data Retention

Customer data is retained for the duration of the service agreement and thereafter per applicable EMS regulations and state record retention requirements (typically 7-10 years for patient care records). De-identified data may be retained for analytics. You may request export or deletion subject to legal retention obligations.

7. NEMSIS Data Submissions

The EMS1R ePCR system was built directly from the NEMSIS v3.5 data format and continuously syncs with updates to the standard in real time. NEMSIS certification is currently in progress. Data is transmitted directly to authorized state repositories over secure, encrypted channels, with integrity validation and submission audit logs.

8. Information Sharing and Disclosure

We do not sell your personal information. We share information only with service providers (Google Cloud Platform under strict data processing agreements), when required by law, in connection with business transfers, with your consent, or with state EMS agencies for NEMSIS submissions.

9. Your Rights

HIPAA: patients maintain all rights under HIPAA — access, amendment, and accounting of disclosures — directed to the Covered Entity (the EMS agency). California residents (CCPA/CPRA): right to know, request deletion, opt out of sale (we do not sell personal information), and non-discrimination.

10. Cookies

Our website uses essential cookies for site functionality. We do not use third-party advertising cookies. Analytics cookies, if used, collect only de-identified usage data.

11. Children's Privacy

Our platform is not directed to individuals under 18. Patient data involving minors is handled exclusively through the Covered Entity under HIPAA protections.

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you") and DiMana Systems, LLC ("EMS1R," "we," "us"), a Florida limited liability company, governing your access to and use of the EMS1R platform, website (ems1r.com), and related services (collectively, the "Services").

2. Description of Services

EMS1R provides a cloud-based EMS operations platform that includes, but is not limited to: Computer-Aided Dispatch (EMSCAD), Mobile Data Terminal (EMS2GO), Crew Scheduling (EMSCS), Human Resources Management (EMSHR), Fleet and Asset Management (EMSFT), Electronic Patient Care Record (EMSPCR), Ambulance Ordering (EMS4U), Artificial Intelligence (EMSAI), and Business Intelligence and Analytics (EMS4BI).

3. Account Registration and Security

You must provide accurate registration information, maintain the confidentiality of your credentials, notify EMS1R of any unauthorized access, and are responsible for all activities under your account. Biometric authentication, RFID, and multi-factor authentication are supported.

4. Subscription and Pricing

EMS1R pricing is per-call (dispatch/incident), not per-user or per-vehicle. All platform modules are included in the subscription at no additional per-module cost. Specific pricing is provided upon request and formalized in a separate Order Form or Service Agreement. Prices are subject to change with 60 days written notice.

5. Service Level Agreement (SLA)

Platform availability is backed by the underlying cloud provider's SLA (e.g., Google Cloud 99.99%); automated failover within 30 seconds; triple-redundant, multi-region infrastructure; 24/7 monitoring; scheduled maintenance communicated 72 hours in advance. Service credits per the Service Agreement.

6. HIPAA and Compliance

EMS1R operates as a Business Associate under HIPAA. Covered Entities must execute a BAA prior to transmitting PHI. AES-256 at rest, TLS 1.2+ in transit, Row-Level Security for agency-level isolation, and prompt notification of any security incident involving PHI.

7. NEMSIS Compliance

The EMS1R ePCR system was built directly from the NEMSIS v3.5 data format and is continuously updated in real time with changes to the standard, ensuring 100% structural compliance. NEMSIS certification is currently in progress. Customer is responsible for the accuracy of clinical data; EMS1R provides real-time validation tools.

8. Customer Data and Ownership

You retain all rights, title, and interest in your data. EMS1R receives a limited license to process it solely to provide the Services. Data export in standard formats within 30 business days of written request. Post-termination retention follows applicable EMS record retention laws; de-identified aggregated data may be used for platform improvement.

9. Acceptable Use

No unlawful use, unauthorized access attempts, reverse engineering, malware, service disruption, credential sharing, or storage of data unrelated to EMS operations.

10. Intellectual Property

The EMS1R platform is the exclusive property of DiMana Systems, LLC. The subscription grants a non-exclusive, non-transferable license for the subscription term. No ownership rights are transferred.

11. API and Integrations

Bidirectional API access for third-party integration; custom API development available upon request; subject to rate limits and security requirements. EMS1R is not responsible for third-party systems connected via API.

12. Limitation of Liability

To the maximum extent permitted by law: total aggregate liability shall not exceed the amount paid in the twelve (12) months preceding the claim; no liability for indirect, incidental, special, consequential, or punitive damages. EMS1R is a technology platform and does not provide medical advice — clinical decisions remain the sole responsibility of licensed EMS professionals.

13. Indemnification

You agree to indemnify DiMana Systems, LLC from claims arising from your use of the Services, violation of these Terms or applicable law, or data you submit through the platform.

14. Termination

Either party may terminate with 90 days written notice; EMS1R may suspend or terminate for material breach after 30 days notice and opportunity to cure, or immediately if required by law or to prevent security threats. Data export is available for 90 days following termination.

15. Force Majeure

Neither party is liable for delays or failures resulting from causes beyond their reasonable control, including natural disasters, acts of government, pandemics, internet outages, or third-party service provider failures.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida. Disputes shall be resolved through binding arbitration in Miami-Dade County, Florida, per the rules of the American Arbitration Association. Each party bears its own costs.

17. Modifications

Material changes will be communicated via email at least 30 days before taking effect. Continued use after changes become effective constitutes acceptance.

18. Severability

If any provision is found unenforceable or invalid, it shall be limited or eliminated to the minimum extent necessary so that these Terms otherwise remain in full force and effect.
